BOURBON TRAIL SWEEPSTAKES TERMS & CONDTIONS

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: Open to legal residents of the 50 United States and Washington DC (EXCLUDING RESIDENTS OF OVERSEAS MILITARY INSTALLATIONS, PUERTO RICO, AND OTHER U.S. TERRITORIES) who as of the time of entry are 21 years of age or older (and at least age of majority in state). The winner’s age will be verified at the time of final winner announcement. Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law.

3. Agreement to Official Rules: By participating in the Sweepstakes, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsors, which are final and binding in all matters related to the Sweepstakes.

4. How to Enter:

A. To enter the “Bourbon Trail” Sweepstakes (the “Sweepstakes”), visit the bespokepost.com website at [insert link], follow the registration and entry directions provided. You can also mail in an entry in a No.10 envelope to: “Bourbon Trail” c/o Bespoke Post, Marketing Department, 151 W 25th, Floor 5, New York, NY 10001, or via email without obligation, email your name, street address, city, state, ZIP code, email address and daytime phone number to contest@bespokepost.com. All mail-based entries must be sent by the end of the competition Entry Period and received by the Sponsors no later then 9/25/2016. All email-based entries must be sent by the end of the competition Entry Period and received by the Sponsors no later than one hour following the end of the competition Entry Period. Incomplete entries are deemed null and void.

B. By entering you are agreeing to the terms and conditions set. Entering with opt-in box checked, you agree to receive emails and join the newsletter lists of Sponsors and confirming you are of 21 years of age or older. Users can unsubscribe from the mailing lists at any time.

C. Entries will be accepted online starting on or about 08/29/2016 and ending 09/16/2016. All online entries must be received by 09/16/2016 11:59PM EST.

D. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsors.

E. Limit one entry per person. All entries must be received by the close of entry period. Participants may not enter with multiple email addresses nor may entrants use any other device or artifice to enter multiple times during entry period or under multiple identities. Any participant who attempts to enter during entry period with multiple email addresses under multiple identities or uses any device or artifice to enter multiple times will be disqualified and forfeits any and all prizes won, in Sponsors’ discretion. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of the Sponsors.

F. No mechanically reproduced or computer generated entries permitted. Sponsors are not responsible for lost, late or misdirected entries, or entries containing incorrect or incomplete information. Not responsible for any problems or technical malfunctions of any telephone network or lines, computer, on-line, or Internet systems or services, servers, computer equipment, software, failure of any email or entry or confirmation or winners notice on account of technical problems or traffic congestion on the Internet, problems with bespokepost.com website or any combination thereof, including any injury or damage to entrant’s or any other person’s computer resulting from downloading any materials in connection with the Sweepstakes. Entries become the property of Sponsors’ and will not be acknowledged or returned.

5. Winner(s):

A. Selection of Winner. Within fourteen (14) days of the closing date, one (1) winner will be randomly selected from the pool of eligible entries under supervision of the Sponsors.

B. Odds. The odds of winning depend on number of eligible entries received.

C. The winners will be notified by e-mail. The Sponsors shall have no liability for any change in email address of entrants nor the winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 14 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.

D. The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSORS’ SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

6. Prize(s):

A. One (1) winner will receive the following prize (the “Prize”):

A $1500 pre-paid cash card to use towards the cost of airfare, (3) night hotel stay in downtown Louisville, (1) lunch, (1) dinner, (2) Churchill Downs tickets.
Private transportation services for the weekend’s activities and (1) exclusive tour in three distilleries on an 8-hour Bourbon Trail tour.

B. ARV of Prize: $3500. Actual retail value of the Prize may vary due to dates and other circumstances. Winner will not receive the difference between the actual and approximate retail value.

Certain restrictions may apply. All bookings and reservations are subject to availability at hotel, distilleries, and Churchill Downs.
If the winner chooses dates outside of when Churchill Downs has races, this part of the prize will simply be a visit to the grounds.
Winner is responsible for any expenses not expressly included in the Prize description, such as additional ground transportation expenses, incidentals, meals, beverages and any other expenses. Winner and Travel Companion must travel on the same itinerary, and must have all necessary identification and/or travel documents required for international travel (e.g., a valid U.S. passport).

C. Sponsor and/or Prize Provider reserves the right to substitute a prize of equal or greater value. No substitution or transfer of prize permitted except as provided herein. Prizes are non-redeemable for cash. In the event of unavailability, Sponsors and/or Prize Provider may substitute a prize of greater or equal value.

7. General:

A. Employees, directors and officers of the Sponsors, Prize Providers, their parents, affiliates, subsidiaries, advertising or promotional agencies, and their immediate family members and/or those living in same household are not eligible.

B. All federal, state, and local taxes are the sole responsibility of the winner. Winner will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more. Consult with your tax professional regarding potential tax implications. Should the ARV of the prize equal or exceed $600, winners shall be required to provide a Social Security Number and necessary tax form for issuance of a 1099 Form.

C. Return of prize notification as undeliverable or inability to locate winner within 5 days after notification will result in disqualification. If the potential winner cannot be reached, forfeits the prize, is disqualified for any reason, or if the prize or prize notification is returned as undeliverable, Sponsors will select an alternate potential winner in a random drawing from among all remaining eligible entries. Travel Companion must also execute a Release of Liability Form prior to ticketing. Winner's Travel Companion must be 21 or older (and at least age of majority in state). Winner and Travel companion will be solely responsible for obtaining valid identification relating to acceptance and use of the travel prize.

D. As a condition of entering the Sweepstakes and winning the Prize, the Winner consents to his/her information (and Travel Companion’s information) being sent to the Prize Provider. The Prize Provider will coordinate the resort component of the Prize directly with the Winner.

E. If in the judgment of Sponsors, air travel is not required due to prize Winner's proximity to prize location, ground transportation may be substituted for roundtrip air travel at Sponsors’ sole discretion. Sponsors will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates, or vouchers or certificates.

F. By participating in the Sweepstakes and accepting any prize, entrants and winners and travel companions agree to release and hold harmless Sponsors, Prize Providers, their respective parent companies, subsidiaries, affiliates and related companies, and each of their respective officers, directors, employees and agents (collectively, "Released Parties") from and against any and all liability whatsoever for any loss, harm, damage, injury, cause of action, claim, cost or expense (including without limitation any property damage, personal injury and/or death) arising out of or in connection with the Sweepstakes, including without limitation participation in any Sweepstakes-related activity and/or possession, acceptance, use or misuse of any prize.

G. Released Parties shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any performer(s)/event(s), air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. The passenger contracts in use by the airlines, car rental companies, or other transportation companies shall constitute the sole contracts with respect to the Winner's and his/her Travel Companion’s transportation and such contracts shall be solely between the Winner, his/her Travel Companion and such transportation companies. Released Parties shall not be parties to such contracts and shall assume no responsibility in this connection. Released Parties shall not be liable for any loss, theft or damage of cash, cameras, jewelry, securities, heirlooms, negotiable papers or other valuables.

H. Released Parties are not responsible if Sweepstakes cannot take place or if prize cannot be awarded due to travel cancellations, postponements, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.

I. Sponsors’ failure to enforce any term of these rules shall not constitute a waiver of that provision.

J. Participation in the Sweepstakes constitutes consent to use entrant’s name, biographical information, image and likeness for editorial, advertising and publicity purposes without additional compensation, except where prohibited by law. Entrant releases and holds harmless the Released Parties for any liability, claims and causes of action based on defamation or violation of rights of publicity or privacy.

K. Sponsors reserve the right to disqualify any person tampering with the entry process, the operation of bespokepost.com or who is otherwise in violation of the Official Rules. Sponsors further reserve the right to cancel, terminate or modify the Sweepstakes in the event the Sweepstakes is not capable of completion as planned, including infection by computer virus, bugs, tampering, or technical failures of any kind. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. CAUTION: ANY ATTEMPT BY ANY PARTICIPANT TO DELIBERATELY DAMAGE THE WEBSITE OR TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT(S) TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION.

L. Winner acknowledges that Released Parties have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and Winner agrees to look solely to such manufacturers for any such warranty and/or guarantee.

M. ARBITRATION and WAIVER OF CERTAIN DAMAGES: As a condition of participating in this Sweepstakes, entrants agree that (a) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other indirect damages, (b) all causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by arbitration under the rules of the American Arbitration Association before a single arbitrator located in New York County, New York; and (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred including costs associated with entering this promotion, but in no event shall any award include attorney’s fees. Disputes arising from this Sweepstakes will be determined according to the laws of the State of New York, without reference to its conflict of laws principles.
